California: Everything You Need to Know

California Laws

In November 2016, medical marijuana was legalized in California under Proposition 64, which allows adults aged 21 and older to legally possess and use therapeutic medical products with a California MMJ Card. Here are the laws regarding holding a medical card in California:

  • Proposition 64 (Adult Use Act) was passed in November 2016 and legalized recreational use for adults aged 21+ in California.
  • It allows cultivation of up to 6 cannabis plants per residence for personal use by adults 21+.
  • Cultivation must be in a private residence, with plants not visible to public view.
  • Driving under the influence is illegal.
  • Public consumption is prohibited; consumption is largely limited to private residences or licensed premises (if local laws permit).

2016 – Adult Use of Marijuana Act

  • Proposition 64 was approved by voters and legalized recreational marijuana for adults 21 and older.
  • Taxes start to apply to the commercial production and distribution of marijuana.

2018 – Legal Sales Begin

  • On January 1, 2018, licensed recreational marijuana sales officially began following Proposition 64.
  • The Bureau of Cannabis Control (BCC) has been established to regulate the cannabis industry.

FAQs

Adults may qualify if they have a condition recognized under California medical cannabis law, such as HIV/AIDS, anorexia, arthritis, cachexia, cancer, chronic pain, glaucoma, migraine, persistent or severe nausea, seizures including epilepsy, or persistent muscle spasms. Other chronic or serious conditions may also qualify if they substantially limit major life activities or could cause serious harm if left untreated. A licensed physician must determine whether medical cannabis is appropriate for your condition.

A California medical marijuana card is generally valid for one year from the issue date. You can start the renewal process up to 60 days before your card expires. Renewing early can help prevent a gap in your medical cannabis documentation.

Most LeafyRX patients receive physician approval on the same day they complete their online evaluation, if they meet the eligibility requirements. If you register with California's state medical cannabis program, official registry documentation may take a few business days, depending on state processing times.

Yes. Recreational cannabis is legal in California for adults 21 and older. However, a California medical marijuana card can still provide benefits for eligible patients, including access for qualifying patients under 21, potentially lower taxes on medical cannabis purchases, and higher medical possession limits in certain circumstances. Some patients choose to keep a medical card even though recreational cannabis is legal.

Yes. Eligible medical cannabis patients may cultivate cannabis for personal medical use, subject to California state and local rules. Under state law, a qualified patient may generally grow up to six mature or 12 immature cannabis plants at their residence. Qualified patients may also possess up to 8 ounces of dried cannabis, subject to applicable laws and local regulations.

Yes. Eligible California residents can apply for a medical marijuana card and obtain a physician's recommendation through an online evaluation. Out-of-state patients should check the current California requirements before applying, as eligibility and card options can vary based on residency and the specific program.

You may not qualify if you do not have a qualifying medical condition, provide false or misleading information, or cannot complete the required physician evaluation. A licensed California provider reviews your medical information during the LeafyRX telehealth evaluation and determines whether you meet the requirements before any applicable state registration fee is paid.

LeafyRX charges a flat fee for the online physician evaluation. Any applicable state registration fees are separate and are paid directly to California. Your total cost can depend on whether you choose to register with the state's medical cannabis program. Check the California card cost guide for the latest pricing details.

Yes. Eligible patients can complete a medical cannabis evaluation through telehealth with a California-licensed physician. With LeafyRX, you complete the online intake, meet with a licensed doctor by video or phone, and receive your medical cannabis recommendation digitally if the physician approves you.

You should have a valid government-issued photo ID that confirms your California residency, such as a California driver's license or state ID. During your telehealth evaluation, you may also need to provide information about your medical history, symptoms, and current medications. For the LeafyRX online evaluation, an in-person doctor's visit is not required.
